NÜVE – CLARIFICATION TEXT FOR WEBSITE VISITORS


INTRODUCTION

This Clarification Text for Website Visitors (“Clarification Text”) is provided by Nüve Sanayi Malzemeleri İmalat Ve Ticaret Anonim Şirketi (“Nüve”), located at Saracalar Mahallesi Saracalar Kümeevleri No: 4/2 Akyurt (Former Esenboğa Road, 22nd Km.) Akyurt/Ankara and operating under tax identification number 6320050327, has been prepared to ensure that the personal data of our website visitors is processed in accordance with the Constitution of the Republic of Türkiye, international agreements related to human rights to which our country is a party, and the relevant legislation, primarily the Personal Data Protection Law No. 6698 (“KVKK”), and to ensure that the rights of the data subjects whose data is processed can be exercised effectively. All personal data shared with Nüve will be processed in a lawful manner, in connection with our activities and service objectives, and in a proportionate manner.

Definitions

The terms personal data, sensitive personal data, and data processing used in this Clarification Text are employed in line with the definitions set forth under KVKK. Within the meaning of KVKK, the term “personal data” refers to any information relating to an identified or identifiable natural person; whereas the term “processing of personal data” refers to any operation performed on personal data, whether wholly or partly by automated means, or, provided that it forms part of a data recording system, by non-automated means, such as collection, recording, storage, preservation, alteration, reorganization, disclosure, transfer, acquisition, making available, classification, or prevention of use.

Principles and Purposes of Personal Data Processing

Pursuant to Article 4 of KVKK, the personal data of the data subject will be processed by Nüve in compliance with the following principles for the purposes stated below:

  • Lawful and fair processing.
  • Accuracy and, where necessary, timeliness.
  • Processing for specified, explicit, and legitimate purposes.
  • Relevance, limitation, and proportionality to the purposes for which they are processed.
  • Retention for the period stipulated in the relevant legislation or required for the purpose for which they are processed.

Nüve processes your personal data, including **Identity** (Name, Surname), **Contact** (Email Address, Telephone Number, Address), **Customer Transaction** (Complaint, Feedback, Survey Responses), **Transaction Security** (IP Address, Other Traffic Data), and **Other** (Product, Serial Number, Purchase Date, Purchasing Company), based on the explicit consent of the data subject or one of the legal grounds for compliance, for the purposes listed below:

  • Conducting product/service marketing processes.
  • Providing after-sales support services for products/services.
  • Managing customer relations processes.
  • Conducting activities aimed at customer satisfaction.
  • Managing information security processes.
  • Following up on requests and complaints.
  • Providing information to authorized persons, institutions, and organizations.
  • Conducting activities in compliance with legislation.
  • Carrying out storage and archiving activities.
  • Conducting/auditing business activities.
  • Exercising access rights.
  • Carrying out communication activities.

Nüve reserves the right to make changes to this Clarification Text if there is a change in the purposes of personal data processing.

Transfer of Personal Data

Nüve transfers personal data in accordance with the regulations stipulated in the KVKK. Except for the exceptional cases provided in the legislation, your data will not be transferred to third parties without your explicit consent. In exceptional cases foreseen by the laws, data may be transferred to authorized administrative or judicial institutions or private organizations.

Method and Legal Reason for Collecting Personal Data

Your personal data is obtained by partially automated means through our website, mobile application, and communication channels. The legal reason for the processing of this data is the exceptions to explicit consent specified in Articles 5/2/c, 5/2/ç, 5/2/d, 5/2/e, and 5/2/f of the KVKK.

Data Subject's Rights and Application Procedure

As a data subject, you have the following rights by applying to Nüve:

  • To learn whether your personal data is being processed and to request information about it if it has been processed.
  • To learn the purpose of the processing of your personal data and whether it is used in line with these purposes.
  • To know the third parties to whom your personal data is transferred domestically or abroad.
  • To request the correction of your incomplete or inaccurate personal data.
  • To request the deletion or destruction of your data within the framework of the conditions set forth in Article 7 of the KVKK.
  • To request that the correction or deletion operations be notified to third parties to whom your data has been transferred.
  • To object to a result against you arising from the analysis of your processed data exclusively through automated systems.
  • To demand compensation for damages in case of suffering harm due to the unlawful processing of personal data.

Application Methods:

You can make your applications using one of the following methods:

  • In person or by mail: Personally or in writing to Nüve’s address "Saracalar Mahallesi Saracalar Kümeevleri No: 4/2 Akyurt (Former Esenboğa Road, 22nd km) Akyurt/Ankara".
  • Through a notary public: By sending a request via notary public to the same address.
  • By e-mail: By sending an e-mail to kvkk@nuve.com.tr.

In the application, it is mandatory to include your name, surname, Turkish ID number (TCKN), residential or business address, e-mail address, telephone number, and information regarding the subject of the request. The information and documents related to the application must be attached to the application. For applications made on behalf of a third person, a notarized special power of attorney must be submitted.

Nüve will respond to properly made applications within 30 days at the latest. If your request requires an additional cost, a fee may be charged according to the tariff determined by the Personal Data Protection Board (“Board”). If a response is provided via a recording medium such as a CD or flash drive, a fee not exceeding the cost of the recording medium may be charged. Nüve may request the necessary information and documents from you to determine if you are the actual owner of the personal data in question and may ask you questions to clarify the matters stated in your application.

Rights of Complaint and Objection:

In case your application is rejected, the response provided is found to be insufficient, or no response is given within the prescribed period, you can file a complaint with the Board within 30 days from the date you learn of the response, or in any case, within 60 days from the date of the application.
